The challenge
Our client was studying medicine at a UK university and had been required to retake elements of his second-year course. As a consequence, his options for clinical placements became restricted.
The student was subsequently allocated to a placement that was unsuitable given his significant caring responsibilities. As the primary carer for two seriously ill family members, the location and structure of the placement would have created considerable practical difficulties and placed additional strain on both the student and those who relied upon his support.
The student had already pursued an appeal through the university’s processes. However, the appeal was rejected without adequate reasons being provided, leaving him in a difficult position with limited formal avenues of challenge remaining.
Our approach
We carried out a detailed review of the university’s decision-making process and identified alternative routes to challenge the outcome despite the student’s formal appeal rights having been exhausted.
Our work included:
- Advising on the university’s regulations governing academic appeals and placement allocations
- Assessing the procedural fairness of the university’s decision-making process
- Developing a strategy that focused on the university’s discretion and ability to make reasonable adjustments
- Working closely with the student to present his caring responsibilities and circumstances effectively
- Preparing detailed submissions identifying where the university had departed from its own procedures
- Inviting the university to reconsider the placement allocation in light of the legal, procedural and policy considerations involved.
Our approach combined a detailed understanding of university regulations with a practical strategy aimed at securing a workable outcome for the student.
The outcome
Following our representations, the university agreed to revisit the matter and exercised its discretion on an exceptional basis.
As a result, the student was granted one of his preferred clinical placements, enabling him to continue his studies while better managing his responsibilities as a carer.
The outcome demonstrated the value of challenging decisions where universities may have failed to properly consider relevant circumstances or their own procedural requirements.
Why this matters
Students often assume that a rejected appeal represents the end of the matter. However, universities may be willing to reconsider decisions where concerns about procedural fairness, policy compliance or personal circumstances are properly presented.
This case highlights the importance of understanding university regulations and identifying alternative routes to resolution, even when formal appeal rights have been exhausted. With the right strategy, students can secure outcomes that better reflect their individual circumstances and academic needs.
