The following case study is based on the provision of legal services at Celia Whittuck’s last place of employment.
The challenge
Our client’s child had experienced sustained verbal and physical bullying while attending secondary school. The bullying resulted not only in physical injury but also significant distress and anxiety.
The timing of these issues was particularly concerning, as they arose during Year 11 when the pupil was preparing for GCSE examinations. The impact of the bullying threatened to affect both the pupil’s wellbeing and their performance in a crucial set of assessments that would influence future educational opportunities.
The parent needed guidance on the school’s responsibilities, the support available to their child, and the steps that could be taken to ensure the pupil was not disadvantaged in their examinations as a result of the circumstances they had experienced.
Our approach
We provided comprehensive advice on both the school’s obligations and the options available to support the pupil during their examinations.
Our work included:
- Advising on the school’s policies relating to bullying, complaints and examinations
- Explaining the relevant government and regulatory guidance concerning peer-on-peer abuse
- Advising on access arrangements and special consideration for GCSE examinations
- Assisting the parent in obtaining appropriate medical evidence to support adjustment requests
- Supporting applications for access arrangements, including the use of a laptop and additional examination time
- Preparing carefully drafted correspondence to the school that highlighted concerns about its handling of the bullying while maintaining a constructive approach focused on securing support for the pupil.
Throughout the matter, we sought to balance robust advocacy with practical collaboration, ensuring the pupil’s immediate educational needs remained the priority.
The outcome
As a result of our involvement, the school agreed to implement the recommended examination support and adjustments.
The pupil went on to perform well in their GCSE examinations. The special consideration arrangements contributed to improved marks in key subjects, helping the pupil achieve grades that more accurately reflected their true abilities and potential.
Why this matters
Bullying can have a profound impact on a child’s wellbeing, confidence and academic performance, particularly when it occurs during key examination years. Schools have important safeguarding responsibilities and must take appropriate steps to address bullying and support affected pupils.
This case demonstrates the importance of understanding the support mechanisms available within the education system. Where bullying or other significant circumstances affect a student’s ability to perform in examinations, access arrangements and special consideration can play a vital role in ensuring a fair outcome.
