The challenge

Our client faced a sexual misconduct process with significant consequences for their academic future, reputation and career prospects. From the outset, concerns arose regarding the fairness of the procedure and the student’s ability to participate effectively in the process.

The student was suspended at an early stage, and there were concerns regarding the information provided to them, the manner in which evidence was being considered and the overall transparency of the decision-making process. Given the potentially life-changing consequences of the proceedings, it was essential that the university followed a fair and lawful procedure.

As the matter progressed, additional concerns emerged regarding procedural fairness and whether relevant evidence had been fully considered before key decisions were made.

Our approach

We represented the student throughout the disciplinary proceedings and subsequent challenges.

Our work included:

  • Advising on the university’s disciplinary procedures and regulatory framework
  • Identifying procedural concerns within the investigation and decision-making process
  • Preparing detailed written representations and appeals
  • Challenging the fairness of the university’s approach and its treatment of key evidence
  • Advising on legal principles and the requirements of procedural fairness
  • Commencing judicial review proceedings to challenge the lawfulness of the university’s decision.

Throughout the case, our focus was on ensuring that the student received a fair process and that the university’s decisions were properly scrutinised.

The outcome

Following the legal challenge, a resolution was reached under which the university agreed to set aside the expulsion decision. The student was permitted to return to their studies and complete their degree.

The student subsequently graduated with a 2:1 degree and was able to pursue their intended professional career.

Why this matters

University disciplinary proceedings can have profound implications for a student’s education and future opportunities. Where concerns arise regarding procedural fairness, transparency or decision-making, obtaining specialist advice at an early stage can be critical.

This case highlights the importance of robust legal representation in sexual misconduct proceedings within higher education. Such matters are often highly sensitive, factually complex and capable of having profound consequences for those involved. Where disciplinary processes fall short of the standards of fairness required, effective legal challenge can be critical in protecting students’ rights and securing outcomes that safeguard both their education and future.
