The Expansion Worker visa enables overseas businesses to establish a UK presence by transferring key personnel. Expert legal advice helps secure sponsorship, ensure compliance and support a smooth, strategic expansion into the UK market.
The UK Expansion Worker visa enables overseas businesses to establish a UK presence by sending a senior manager or specialist employee to set up a branch or wholly owned subsidiary.
Part of the Global Business Mobility route, the Expansion Worker visa is designed for businesses that have not yet started trading in the UK but are looking to enter the market. It provides a practical route for organisations seeking to expand internationally while ensuring compliance with UK immigration requirements.
What is the UK Expansion Worker visa?
The Expansion Worker visa allows an overseas business to transfer a senior employee to the UK to establish a trading presence.
To use this route, the overseas business must obtain a UK Expansion Worker sponsor licence and assign a Certificate of Sponsorship to an eligible employee. The sponsored worker can then apply for a visa to come to the UK and oversee the business’s expansion plans.
The route replaced the former Sole Representative visa for new applicants and forms part of the UK’s Global Business Mobility framework.
Who can apply?
An applicant may qualify if they:
- Are aged 18 or over
- Are currently employed by an overseas business
- Are coming to the UK to establish the business’s first UK presence
- Meet the relevant salary requirements
- Meet the financial maintenance requirements, where applicable.
In most cases, the applicant must have worked for the overseas business outside the UK for at least 12 months before applying, although exemptions may apply in certain circumstances.
Key requirements
To sponsor a worker under this route, the overseas business must:
- Be actively trading overseas
- Intend to establish a branch or wholly owned subsidiary in the UK
- Not already be trading in the UK
- Demonstrate a genuine expansion plan.
The Home Office will assess whether the business is genuine and whether there is a credible intention to establish a UK trading presence.
UK Expansion Worker sponsor licence
Before a worker can apply for a visa, the business must secure a sponsor licence.
The sponsor licence application requires detailed evidence demonstrating:
- The trading activities of the overseas business
- The ownership structure of the organisation
- The proposed UK expansion plans
- The relationship between the overseas entity and UK operation
- The suitability of nominated key personnel.
Obtaining the sponsor licence is often the most complex part of the process.
What does it allow?
The UK Expansion Worker visa allows a senior manager or specialist employee to transfer to the UK to oversee the expansion.
If your application is successful, you will be able to:
- Live and work in the UK for your sponsoring employer
- Establish and develop the UK branch or subsidiary of an overseas business
- Travel freely to and from the UK during the validity of your visa
- Bring eligible family members to the UK as dependants
- Extend your permission to stay up to a total of two years
- Study alongside your sponsored employment.
The route is designed to support genuine overseas businesses looking to enter the UK market and provides a structured framework for establishing UK operations before commencing trading activities.
While the Expansion Worker visa does not lead directly to settlement, it can form part of a wider immigration strategy for businesses seeking a long-term presence in the UK. Once the UK entity is established and trading, it may be possible for sponsored workers to move into alternative immigration routes that offer a pathway to settlement, including a Skilled Worker visa through the company (subject to obtaining the appropriate licence tier).
