Following a fair redundancy process protects your organisation from legal risk, maintains employee trust, and ensures legal compliance. It supports transparency, reduces disputes, and safeguards your reputation during challenging workforce changes.
Strategic support for complex workforce changes
Restructuring and redundancy decisions are among the most challenging issues HR leaders face. They carry legal, operational, and reputational risks, and getting them wrong can be costly. We provide clear, pragmatic guidance to help you manage these processes fairly, efficiently, and in line with your business objectives.
When redundancies arise
Redundancies typically occur when:
- A business closes entirely
- A workplace shuts down
- There’s a reduced need for certain roles due to organisational change.
Whatever the reason, employers are required to follow a fair and transparent process. From placing employees ‘at risk’ to selecting employees and consulting on alternatives, every step matters. We’ll help you navigate these requirements with confidence.
Collective consultation
If 20 or more employees may be dismissed at one workplace within 90 days, collective consultation rules apply. This means engaging with trade unions or elected employee representatives. You must also notify the Department for Business, Energy and Industrial Strategy via an HR1 form – a legal obligation that, if missed, is a criminal offence. We ensure you meet these obligations and avoid costly mistakes.
Redundancy pay and settlement agreements
Employees with two years’ service are entitled to statutory redundancy pay, calculated by age, service length, and capped weekly pay. If you offer enhanced packages, we’ll advise on fair, non-discriminatory criteria and draft settlement agreements to protect your business from future claims.
How can we support you?
We partner with HR leaders to deliver:
- Fair and defensible selection processes
- Effective individual and collective consultation strategies
- Guidance on redundancies linked to mergers or business transfers
- Settlement agreements and dispute resolution
- Support to minimise legal risk and maintain employee trust.
