LGBTQIA+ Rights at University

Legal services for university students

Students may seek legal advice when their LGBTQIA+ rights aren’t respected, discrimination occurs, policies are misapplied, or universities fail to provide safe, inclusive environments or appropriate protections for their wellbeing.

LGBTQIA+ students should feel safe, respected and supported throughout their university experience. When discrimination or unfair treatment occurs, it can have a serious impact on both wellbeing and academic progress.

When your rights may have been breached

Direct discrimination

Direct discrimination happens when you are treated less favourably because of a protected characteristic. Sexual orientation and gender reassignment are protected under the Equality Act.

Indirect discrimination

Indirect discrimination occurs when a policy or rule that applies to everyone places LGBTQIA+ students at a disadvantage. Even if the policy was not intended to cause harm, it may still be unlawful.

Harassment

Harassment includes behaviour that violates your dignity or creates a hostile or intimidating environment. Bullying, exclusion, derogatory comments or persistent unwanted behaviour connected to your identity may breach the Equality Act.

Victimisation

Victimisation arises when a student is treated poorly because they have complained about discrimination or supported another student. This is also unlawful.
