University Fee Status Disputes

Legal services for university students

University fee status decisions can have a lasting impact on a student’s future and can affect whether a university place is viable. Legal advice can help to ensure the decision has been made correctly and, where appropriate, to challenge it with strong, properly presented evidence.

Disputing fee status can be stressful and uncertain for both students and parents. Decisions are based on complex rules, may require extensive documentation and can delay enrolment, and an incorrect classification can lead to significantly higher tuition fees and financial pressure.

Understanding fee status disputes

Universities in England and Wales are required to assess whether a student qualifies for home or overseas fee status based on nationality, immigration status and ordinary residence in the three years before the course starts.

Broadly, students with British citizenship or settled status who meet the three year ordinary residence requirement are likely to be classed as home fee students. Those who do not meet these criteria are often classed as overseas students. Universities also recognise routes to home status for refugees and those with humanitarian protection, and for some family members, provided residence requirements are met.

However, a British passport alone does not guarantee home fee status. In cases where the position is unclear, university admissions teams will usually send a fee status questionnaire to a student, to gain a greater understanding of the individual’s position. In some cases, universities will reassess a student if evidence shows a qualifying change such as gaining indefinite leave to remain or settled status.

An incorrect decision can have a significant financial and practical impact. Home fees are capped (from September 2026 up to £9,790 per year), while overseas fees can range from around £30,000 to £70,000 annually, depending on the university and course. This can affect access to education and make a decisive difference to family finances.

Challenging fee status decisions

Parents seeking to challenge their son or daughter being classified as an overseas student may seek legal advice in the following circumstances:

• A child with a British passport has lived abroad and the university queries ordinary residence in the UK
• A student is offered a place as a home student but is reclassified after further checks by the university
• An admissions team requests extensive documents and delays enrolment pending fee status decisions.

Although universities apply the same legislation to each student, every application is considered individually. In some instances, a university may need additional evidence from the student and their parents where residence includes time overseas or where immigration status has changed.
