Understanding fee status disputes
Universities in England and Wales are required to assess whether a student qualifies for home or overseas fee status based on nationality, immigration status and ordinary residence in the three years before the course starts.
Broadly, students with British citizenship or settled status who meet the three year ordinary residence requirement are likely to be classed as home fee students. Those who do not meet these criteria are often classed as overseas students. Universities also recognise routes to home status for refugees and those with humanitarian protection, and for some family members, provided residence requirements are met.
However, a British passport alone does not guarantee home fee status. In cases where the position is unclear, university admissions teams will usually send a fee status questionnaire to a student, to gain a greater understanding of the individual’s position. In some cases, universities will reassess a student if evidence shows a qualifying change such as gaining indefinite leave to remain or settled status.
An incorrect decision can have a significant financial and practical impact. Home fees are capped (from September 2026 up to £9,790 per year), while overseas fees can range from around £30,000 to £70,000 annually, depending on the university and course. This can affect access to education and make a decisive difference to family finances.
